The plaintiffs claimed that the Bank's "Repossession Notices" and "Deficiency Notices" were improper and commercially unreasonable. The Bank denies any wrongdoing. The Court has not decided who is right but has granted preliminary approval to the settlement.

Consumers in Pennsylvania and New York who had a vehicle repossessed by Five Star Bank between May 16, 2011, and September 30, 2021, may be eligible for a payment.

Eligibility

You may qualify if you financed a vehicle for personal use through Five Star Bank, it was repossessed between May 16, 2011, and September 30, 2021, and you lived in Pennsylvania or New York at the time of the repossession. Eligibility also depends on the type of notice you received (or didn't receive) from the bank.

Financed a vehicle for consumer use with Five Star Bank.

Had your vehicle repossessed by Five Star Bank.

Had a Pennsylvania address at the time of repossession (Classes A & B).

Had a New York address at the time of repossession (Classes C & D).

Received a "Repossession Notice" that failed to state the sale method or listed a lump sum "storage cost".

Received a "Deficiency Notice" that failed to provide information in the correct order.

Received no notice at all after repossession.
