A federal court has found that Google illegally monopolized the digital advertising market for over 15 years - and businesses that purchased Google Ads may be entitled to compensation.
Google controlled every layer of the digital advertising system: the tools advertisers use to buy ads, the tools publishers use to sell ad space, and the auction exchange connecting them. By locking this system together and blocking outside competition, Google forced businesses to pay inflated prices with no meaningful alternative.
In April 2025, U.S. District Judge Leonie Brinkema ruled that Google willfully acquired and maintained monopoly power in the markets for publisher ad servers and ad exchanges. On September 16, 2026, the court issued its remedies ruling, ordering Google to open its ad auction system to competitors and appointing an antitrust compliance monitor to oversee six years of behavioral changes. The DOJ called the outcome a significant victory for competition.
Separately, a class action on behalf of publishers was certified in December 2025, and mass arbitration proceedings are actively underway for advertisers seeking compensation for overcharges.
Under federal antitrust law, eligible businesses may recover up to triple their actual damages.
