Homebuyers sued the National Association of REALTORS® (NAR) and more than 20 real estate brokerages, claiming they created and enforced rules that kept buyer broker commissions artificially high. The defendants deny the allegations but have agreed to a class action settlement. The case is Tuccori et al. v. At World Properties, LLC et al., No. 1:24-cv-00150, in the U.S. District Court for the Northern District of Illinois.
The settlement creates a $120,334,500 fund. After court-approved attorneys' fees, expenses, service awards and administration costs are paid, the rest will be split pro rata among class members who file valid claims. Each payment will depend on how many valid claims are filed, how many homes you bought and how much commission was paid in those purchases. Individual amounts have not been announced, and payments are expected in installments over several years. The settling defendants also agreed to changes to certain business practices.
The deadline to file a claim is October 27, 2026. The deadlines to opt out or object passed on September 17, 2026. The court will hold the final approval hearing on November 2, 2026, and has not yet granted final approval for the settlement.

You may qualify if you bought a home in the United States that was listed on a Multiple Listing Service (MLS) and a commission was paid to any real estate brokerage in the purchase.
Earlier purchases qualify in many states. Purchases may qualify from as early as January 25, 2006 in Puerto Rico, January 25, 2011 in Rhode Island and Louisiana, January 25, 2013 in Wyoming, and January 25, 2015 in many other states. The Settlement Class includes all persons who purchased a home that was listed on an MLS anywhere in the United States where a commission was paid to any brokerage in connection with the transaction during the Class Periods.

The Settlement Class does not include people who submitted a valid request to be excluded, the parties' lawyers, the Special Master for Mediation, or the judge and court staff assigned to the case and their immediate families. Members of the earlier home seller settlements are excluded only as to the claims they already released in those settlements.

You can qualify even if you did not work with one of these companies. What matters is that the home was listed on an MLS and a commission was paid to any brokerage in the purchase.
You may be able to. This settlement is based on home purchases. If you were a member of the home seller settlements in Burnett, Gibson, Keel or Hooper, you are excluded from this Settlement Class only as to the claims you already released in those settlements. A home you bought during the Class Period may still qualify.

The best document is your settlement statement (sometimes called an ALTA statement) or HUD-1 for each home. These usually list the commissions paid to every brokerage in the sale, including commissions the seller paid.
A buyer's Closing Disclosure often leaves out commissions the seller paid, so upload your settlement statement if you have it and use the Closing Disclosure only if it is all you have. If you can't find your closing documents, your title company or closing attorney can usually send you a copy.
